Terms of Service

These Terms of Service ("Terms") govern your use of the Rivalto mobile application and website (collectively, the "Service"), operated by Gino Falcone / Road to Jesus Ministry ("we", "our", "us"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Rivalto. By using the Service, you represent that you meet this age requirement. Users under 18 should have parental or guardian consent before using the Service. We reserve the right to terminate accounts of users who misrepresent their age.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials.
You must provide a valid email address and a unique username at registration.
You are responsible for all activity that occurs under your account.
You may not impersonate others, use misleading usernames, or create accounts on behalf of others without permission.
You may not share, sell, or transfer your account.

3. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
Harass, bully, abuse, threaten, or harm other users in any way.
Attempt to gain unauthorized access to the Service, other users' accounts, or our backend systems.
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Service.
Use automated scripts, bots, scrapers, or crawlers to interact with the Service.
Post or transmit content that is defamatory, obscene, hateful, or violates any third-party rights.
Manipulate habit completions, streaks, duel results, or any other in-app metric fraudulently.
Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
Use the Service to advertise, promote, or solicit other products or services without our written consent.

4. Health, Fitness & Safety Disclaimer

IMPORTANT — PLEASE READ CAREFULLY. Rivalto is a habit-tracking and accountability platform. It is not a medical service, fitness program, health service, or professional advice platform of any kind. Nothing in the Service constitutes medical, nutritional, fitness, psychological, or any other professional advice.

All habits, activities, challenges, and routines suggested, listed, or tracked within Rivalto are for general informational and motivational purposes only. You choose your own habits entirely at your own discretion and assume full personal responsibility for any and all consequences that arise from the habits you select, pursue, or attempt — including but not limited to physical injury, illness, strain, exhaustion, mental health effects, or any other adverse outcome.

Before beginning any new physical fitness routine, dietary program, or lifestyle change — especially if you have any pre-existing health condition, injury, or medical concern — consult a qualified physician or healthcare professional. By using the Service, you acknowledge that Rivalto, its operators, and affiliates are not responsible for any injury, harm, illness, loss, or damage of any kind resulting from your use of the Service or your participation in any habit or activity tracked within it.

5. User-Generated Content

You may create custom habit names, post daily photo logs, write circle notes, and contribute other content ("User Content") to the Service. You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide license to display, store, and transmit that content within the Service for the purposes of operating the platform.

You are solely responsible for the User Content you submit. You represent that your User Content does not violate any third-party rights and complies with these Terms. We reserve the right to remove any User Content that violates these Terms or that we deem harmful to the community, at our sole discretion and without notice.

6. Subscriptions & Payments

Free tier: Available to all users at no cost. Includes personal habit tracking, streaks, and milestone badges.
Pro subscription: Unlocks 1v1 daily duels, full habit history, Daily Photo Log, Pro profile features, and additional features. Pricing is displayed in-app and may vary by region.
Founding Pro: The first 1,000 users receive 3 months of Pro free. All subsequent users receive 1 month of Pro free upon registration. After the free trial period ends, accounts revert to the free tier unless a paid subscription is active.
Subscriptions are billed through the Apple App Store or Google Play Store and are governed by their respective terms.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
We do not offer refunds except as required by applicable law or platform policy (Apple/Google).
You may cancel your subscription at any time through your device's App Store or Google Play account settings.
We reserve the right to change pricing at any time. Existing subscribers will be notified of any price changes in advance.

7. Intellectual Property

All content, design, trademarks, logos, code, and other materials in the Service are owned by or licensed to us. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our express written consent.

8. Third-Party Services

The Service integrates with third-party providers including Supabase (database and authentication), RevenueCat (subscription management), Apple App Store, Google Play, and Resend (email). Your use of the Service is also subject to the terms and privacy policies of those providers. We are not responsible for the practices of third-party services.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any conduct we determine to be harmful to the Service or its community. Upon termination, your right to use the Service immediately ceases. You may request account deletion at any time by contacting support@rivalto.app or using the in-app delete account feature.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components. We make no guarantee regarding the accuracy, completeness, or reliability of any content within the Service.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Rivalto, Gino Falcone, and Road to Jesus Ministry shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of — or inability to use — the Service. This includes but is not limited to: physical injury or health complications resulting from habits tracked in the app; loss of data, streaks, or in-app progress; loss of profits; emotional distress; or any other intangible losses. Our total aggregate liability to you shall not exceed the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or $50 USD, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rivalto, Gino Falcone, Road to Jesus Ministry, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of or access to the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States of America, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved informally by contacting us at support@rivalto.app. If informal resolution fails, disputes shall be resolved through binding individual arbitration under the rules of the American Arbitration Association. You waive any right to participate in a class-action lawsuit or class-wide arbitration. Where arbitration is not legally enforceable, disputes shall be resolved in courts of competent jurisdiction in the United States.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
