These Terms of Service ("Terms") govern your use of the Rivalto mobile application and website (the "Service"), operated by Gino Falcone ("we", "our", "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use Rivalto. By using the Service, you represent that you meet this age requirement. Users under 18 should have parental consent.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials.
You must provide a valid email address and a unique username at registration.
You are responsible for all activity that occurs under your account.
You may not impersonate others or use misleading usernames.

3. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose.
Harass, abuse, or harm other users.
Attempt to gain unauthorized access to the Service or other users' accounts.
Reverse engineer, decompile, or disassemble any part of the Service.
Use automated scripts or bots to interact with the Service.
Post content that is defamatory, obscene, or violates third-party rights.

4. Subscriptions & Payments

Free tier: available to all users with no charge.
Premium ($4.99/month): unlocks Circles, full stats history, AI monthly insights, and cosmetic features.
Circle Host ($19.99/month): includes Premium benefits plus the ability to invite free users to your Circle.
Subscriptions are billed through Apple App Store or Google Play and are subject to their terms.
We do not offer refunds except as required by applicable law or platform policy.
You may cancel your subscription at any time through your platform account settings.

5. Intellectual Property

All content, design, trademarks, and code in the Service are owned by or licensed to us. You may not reproduce, distribute, or create derivative works without our written consent.

Content you create (e.g., custom habit names, Vibe posts) remains yours. By posting it, you grant us a non-exclusive, royalty-free license to display it within the Service.

6. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, with or without notice. You may delete your account at any time by contacting support@rivalto.app.

7. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. Rivalto is a habit tracking and gamification app — it is not a medical, fitness, or health service.

8. Limitation of Liability

To the fullest extent permitted by law, Rivalto and Gino Falcone shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration or, where arbitration is not permitted, in the courts of competent jurisdiction.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will update the "Last updated" date at the top of this page when changes are made.
